Swim for MS is a great way to incorporate your interest of swimming with your desire to help the MS community. Anyone who has access to a pool can volunteer and you can plan to volunteer around your business, school and family commitments.

Swim for MS can be a backyard pool party, pool volleyball, cannonballs, laps, or a goal to swim a certain distance. There is no limit!


Water Polo:

1) Be sure to have a team of six field players and one goalkeeper. In addition, you may want to have 2-4 players as substitutes and 2 referees.
2) Clearly distinguish between teams by wearing colored swim caps.
3)The game is divided into four periods - each 5-8 minutes long. The game clock is stopped when the ball is not 'in play'.
4)The winner of the game is the team that scores the most goals. Game play involves swimming, treading water, players passing the ball while being defended by opponents, and scoring by throwing the ball into a net defended by a goalie.

Rules:
1) A team may not have possession of the ball for longer than 30 seconds without shooting for the goal unless an opponent commits an ejection foul. After 30 seconds, possession passes to the other team. However, if a team shoots the ball within the allotted time, and regains control of the ball, the shot clock is reset to 30 seconds.
2) Each team may call 2 one-minute timeouts in the four periods of regulation play, and one timeout if the game goes into overtime. During game play, only the team in possession of the ball may call a timeout.
3) The goals are 3 meters wide and 90 centimeters high. Water polo balls are generally yellow and of varying size and weight for juniors, women and men. The middle of the pool is designated by a white line.
4) Players are not permitted to push the ball underwater in order to keep it from an opponent, or push or hold an opposing player unless that player is holding the ball.
5) After each goal is scored, play is re-started at mid-pool; the goalkeepers are not permitted to go across the mid-pool line.
6) A goal counts only when the ball goes completely across the goal line and into the goal (close does not count); the ball is out of bounds if it goes completely across the goal line and not into the goal.
7) No offensive player is allowed to swim inside of the 2-meter line unless he/she has possession of the ball.

According to them, even the 'active' video games aren?t an adequate substitute for good old-fashioned play.

The non-profit organization commissioned an international team of researchers to review over 1300 studies featuring ?exergames? ? video games that encourage getting off the couch to play. And while they found that exergames did a good job of interrupting long periods of sedentary behaviour, they did little to boost the physical activity of children. In fact, there is some inference that active video gaming may be pulling kids away from playing real sports in favor of using a game console as a piece of sports equipment and an avatar as an opponent. They also came up with some suggestions on how to establish a healthier balance between exercise and gaming:
  • Active video games are a good way to break up sedentary time, like sitting on the couch, but not as good as playing real active games or sports.
  • Enjoy playing active video games with your kids, and let them enjoy playing them with their friends, but don?t misunderstand this as a replacement of real physical activity.
  • If money is spent on active video games as a means of exercise, it might be better spent on skipping ropes, balls, ice skates or other sporting equipment.
  • In kids with developmental delays, movement challenges or injuries, active video games can be used to help teach motor skills, improve movement and rehabilitate

Kaz Hirai has promised a "One Sony" that aligns its various capabilities in entertainment and electronics to work better together, and it seems we'll have one of the first examples in its launch of the 84-inch XBR-84X900 LED TV. We spoke to Sony Electronics COO Phil Molyneux about the 4K Ultra HD Video Player that's coming with each purchase of its (MSRP: $24,999.99) beast and why, as he says, it's something "only Sony can do." First, we finally have the confirmed details of this first ever 4K player for the home: it's a hard-disc server, available exclusively on no-additional cost lease to purchasers that's preloaded with 10 full-length feature films (including The Amazing Spider-Man, Total Recall (2012), Taxi Driver, Bridge Over the River Kwai -- see the press release for a full list), a number of short concert / action sports clips from Red Bull, and an Xperia Tablet S packing a special remote control app that's similar to its Movies Unlimited service.

This is the first time home viewers will be able to experience 4K video of this caliber at home, and from the cameras, to its Colorworks digital facility opened in 2009, to the special white glove service charged with periodically updating the hard-disc's content for well-heeled buyers, Sony plans on pushing more soon. Those hoping for another Brad Pitt/David Fincher collaboration in the near future have reason to keep their fingers crossed.? Fincher has been developing a big-budget remake of 20,000 Leagues Under the Sea at Disney for quite some time, and last month we reported that the Mouse House was set to take a close look at the project for greenlight consideration while Fincher was courting Pitt for a lead role.? Now Pitt himself has spoken up about the prospect, and he sounds enthusiastic about teaming up with his Fight Club director for a fourth time.? Hit the jump to see what he had to say.

The director previously stated that the film would be shot in 3D and would probably 70% comprised of CG, and the role that Fincher has earmarked for Pitt is apparently that of Ned Land who was played by Kirk Douglas in the 1954 adaptation.? Seven scribe Andrew Kevin Walker penned the most recent draft of the script, so should scheduling work out with Pitt this would make for a fun reunion of sorts from the team behind the serial killer classic.

Pitt is finishing up reshoots on World War Z at the moment but currently isn?t firmly attached to anything for his next project.? I imagine the scheduling also depends on what Angelina Jolie has coming up, but I sincerely hope things come together for this one.

LG Spectrum 2 (Verizon Wireless)


The original LG Spectrum was a high-end?smartphone with a high-end price tag. Fast forward less than a year later, and we have the LG Spectrum 2. It's designed to compete with the rest of the heavy hitters in Verizon's lineup, and in most regards, it succeeds. But LG made one key difference this time around: Price. The LG Spectrum 2 is a high-end phone, but at $99.99, it costs half the price as other top choices in Verizon's lineup. That makes it a seriously good buy.

Design, Data Speeds, and Call Quality
Today's high-end smartphones are almost unanimously large, and the Spectrum 2 follows suit. It measures 5.31 by 2.69 by 0.39 inches (HWD) and weighs 5.59 ounces, which is a good deal heavier than the 4.69-ounce Samsung Galaxy S III. Physically, the phone looks a bit rectangular and boxy. The back panel is covered in rubberized black plastic, and there are plastic silver accent panels on the sides and matte black panels on the top and bottom. There's an LED-lit Power button on the top and two Volume buttons on the left. Like all big phones, it's difficult to hold the Spectrum 2 in one hand and pull the notifications bar down with your thumb.

The front of the phone is home to a beautiful 4.7-inch, 1280-by-720-pixel IPS LCD. While that resolution pales in comparison to the insane 5-inch, 1080p display on the new HTC Droid DNA, the Spectrum 2 gets incredibly bright, and text and images look sharp. It also looks better than the Galaxy S III, the Motorola Droid Razr HD, or the Droid Razr Maxx HD, all of which use PenTile panels that can make things look a little fuzzy. Given the size, typing on the onscreen keyboard is easy in both portrait and landscape modes.

The LG Spectrum 2 taps into Verizon's 4G LTE network where it's available, and 3G everywhere else. Verizon's 4G LTE network is very fast, and received top honors in our?Fastest Mobile Networks?tests earlier this year. The Spectrum 2 has good reception, and averaged 6Mbps down and 4Mbps up in our speed tests, which is consistent with most results we've seen lately. It can also be used as a mobile hotspot to connect up to 10 devices simultaneously with the proper service plan. And if you want to connect to Wi-Fi, the Spectrum 2 supports 802.11 a/b/g/n over the 2.4 and faster 5GHz bands, so wireless performance is solid across the board.

Call quality is average. Volume goes very loud in the phone's earpiece, but voices get reedy, especially at top volume. Transmissions through the mic are a little fuzzy and voices sound a bit muted, but calls are easy to understand overall. Calls sounded fine through a?Jawbone Era?Bluetooth headset and standard Android voice dialing worked well over Bluetooth. The phone's big 2,150mAh battery was good for a solid 12 hours and 42 minutes of talk time. The phone comes with a wireless charging battery cover, and can be charged wirelessly with a separate charging pad.

Hardware, Android, and Apps
The Spectrum 2 is powered by a 1.5GHz dual-core Qualcomm Snapdragon S4 MSM8960 processor, which is the same chip you'll find in the Galaxy S III and Droid Razr HDs. It makes for excellent performance and benchmark scores comparable to those phones. We've seen this eclipsed by the emergence of quad-core devices like the Droid DNA, but it's still plenty fast?you'll be able to run all of the 600,000+ apps in the Google Play store without a problem.

Risk of childhood obesity can be predicted at birth

ScienceDaily (Nov. 27, 2012) ? A simple formula can predict at birth a baby's likelihood of becoming obese in childhood, according to a study published today in the open access journal PLOS ONE.

The formula, which is available as an online calculator, estimates the child's obesity risk based on its birth weight, the body mass index of the parents, the number of people in the household, the mother's professional status and whether she smoked during pregnancy.

The researchers behind the study hope their prediction method will be used to identify infants at high risk and help families take steps to prevent their children from putting on too much weight.

Childhood obesity is a leading cause of early type 2 diabetes and heart and circulatory disease, and is becoming more common in developed countries. According to NHS figures, 17 per cent of boys and 15 per cent of girls aged two to 15 in England are classified as obese.

The researchers developed the formula using data from a study set up in 1986 following 4000 children born in Finland. They initially investigated whether obesity risk could be assessed using genetic profiles, but the test they developed based on common genetic variations failed to make accurate predictions. Instead, they discovered that non-genetic information readily available at the time of birth was enough to predict which children would become obese. The formula proved accurate not just in the Finnish cohort, but in further tests using data from studies in Italy and the US.

"This test takes very little time, it doesn't require any lab tests and it doesn't cost anything," said Professor Philippe Froguel, from the School of Public Health at Imperial College London, who led the study.

"All the data we use are well-known risk factors for childhood obesity, but this is the first time they have been used together to predict from the time of birth the likelihood of a child becoming obese."

The 20 per cent of children predicted to have the highest risk at birth make up 80 per cent of obese children. The researchers suggest that services such as dieticians and psychologists could be offered to families with high-risk infants to help them prevent excessive weight gain.

"Once a young child becomes obese, it's difficult for them to lose weight, so prevention is the best strategy, and it has to begin as early as possible," said Professor Froguel. "Unfortunately, public prevention campaigns have been rather ineffective at preventing obesity in school-age children. Teaching parents about the dangers of over-feeding and bad nutritional habits at a young age would be much more effective."

Although common genetic variants did not prove to be helpful for predicting childhood obesity, the researchers say about one in 10 cases of obesity are caused by rare mutations that seriously affect appetite regulation. Tests for these mutations could become available to doctors in the next few years as the cost of DNA sequencing technology falls.

The Imperial researchers conducted the study in collaboration with colleagues at the University of Oulu, Finland; Harvard University in the US and the University of Verona, Italy. The work was funded by the Medical Research Council, Imperial College London, the University of Oulu and Centre National de la Recherche Scientifique.

A small molecule known to regulate white blood cells has a surprising second role in protecting brain cells from the deleterious effects of stroke, Johns Hopkins researchers report. The molecule, microRNA-223, affects how cells respond to the temporary loss of blood supply brought on by stroke and thus the cells' likelihood of suffering permanent damage.

"We set out to find a small molecule with very specific effects in the brain, one that could be the target of a future stroke treatment," says Valina Dawson, Ph.D., a professor in the Johns Hopkins University School of Medicine's Institute for Cell Engineering. "What we found is this molecule involved in immune response, which also acts in complex ways on the brain. This opens up a suite of interesting questions about what microRNA-223 is doing and how, but it also presents a challenge to any therapeutic application." A report on the discovery is published in the Nov. 13 issue of the Proceedings of the National Academy of Sciences.

RNA is best known as a go-between that shuttles genetic information from DNA and then helps produce proteins based on that information. But, Dawson explains, a decade ago researchers unearthed a completely different class of RNA: small, nimble fragments that regulate protein production. In the case of microRNA, one member of this class, that control comes from the ability to bind to RNA messenger molecules carrying genetic information, and thus prevent them from delivering their messages. "Compared with most ways of shutting genes off, this one is very quick," Dawson notes.

Reasoning that this quick action, along with other properties, could make microRNAs a good target for therapy development, Dawson and her team searched for microRNAs that regulate brain cells' response to oxygen deprivation.

To do that, they looked for proteins that increased in number in cells subjected to stress, and then examined how production of these proteins was regulated. For many of them, microRNA-223 played a role, Dawson says.

In most cases, the proteins regulated by microRNA-223 turned out to be involved in detecting and responding to glutamate, a common chemical signal brain cells use to communicate with each other. A stroke or other injury can lead to a dangerous excess of glutamate in the brain, as can a range of diseases, including autism and Alzheimer's.

Because microRNA-223 is involved in regulating so many different proteins, and because it affects glutamate receptors, which themselves are involved in many different processes, the molecule's reach turned out to be much broader than expected, says Maged M. Harraz, Ph.D., a research associate at Hopkins who led the study. "Before this experiment, we didn't appreciate that a single microRNA could regulate so many proteins," he explains.

This finding suggests that microRNA-223 is unlikely to become a therapeutic target in the near future unless researchers figure out how to avoid unwanted side effects, Dawson says.

(AP) ? After her father and stepmother were arrested last year for chaining her to a dresser, young Jersey Bridgeman received something of a fresh start when she began kindergarten this fall in northwestern Arkansas.

Then, last week, the 6-year-old's body was found in a vacant home two doors from where she had been living with her mother.

"The fact that she went through what she went through when she was 5. ... And then this happens," Chelsea Jouett said Tuesday after dropping a teddy bear off at Jersey's home. "She had such a rough life."

Police have arrested neighbor and family friend Zachary Holly, 28, in Jersey's death. Holly is due in court Wednesday in Bentonville, a city about 215 miles northwest of Little Rock that is best known as the home of Wal-Mart's headquarters.

Holly was being held on capital murder, kidnapping and residential burglary charges Tuesday night at the Benton County Jail. A judge is likely to appoint a lawyer to represent him during his court appearance Wednesday.

Holly's arrest Monday came about a week after Jersey was found dead in an empty house next to the mobile home where Holly lived. Police said a search turned up the girl's body just minutes after someone reported her missing Nov. 20.

So far, Bentonville police have not said how Jersey died or released any possible motives. Chief Jon Simpson said many questions about the investigation will be answered when a probable cause affidavit comes out Wednesday.

Simpson said Holly worked at a restaurant in town called The Flying Burrito Company. The manager, Tabitha Stevens, confirmed that Holly worked there but declined to comment further.

One neighbor, Julie Pickard, said Tuesday that Holly wept the day Jersey's body was found.

"He was crying for a long time," said Pickard, who lives on the other side of the home where Jersey's body was found.

Later that day, Pickard said, police knocked on her door and told her to let them know if she saw a man wearing Mountain Dew pajama pants.

"(Holly) was wearing Mountain Dew pajama pants," Pickard said.

No one answered the door Tuesday at the mobile home where police say Holly lived with his wife. A child's bicycle rested on a patch of grass near the home.

Simpson, the police chief, told The Associated Press the couple didn't have any children but that Holly's wife has a child who is "pretty much the same age as our victim." Simpson described Holly as "an acquaintance" and a friend of Jersey's family.

Next door, a child's bike with training wheels lay in front of the house where police said Jersey lived with her mother, DesaRae Bridgeman. Nearby was a deflated balloon decorated with the kinds of princesses that fill little girls' dreams.

Less than a mile away, Jersey's family on Tuesday buried the little girl who lived through more than her share of hardship. Police said the family requests privacy as they grieve.

Jersey's death comes after her father and stepmother chained the girl to a dresser last year. David Bridgeman told investigators he restrained his daughter to keep her from getting into medication and other things around the house in nearby Rogers.

David Bridgeman and Jersey's stepmother, Jana Bridgeman, pleaded guilty in June to false imprisonment, permitting abuse of a minor and endangering the welfare of a minor. She is serving a 12-year prison sentence, plus three years for a probation revocation. He is serving an 18-year prison sentence.

Meanwhile, those who knew Jersey are remembering the little girl who was still joyful despite what was, by all indications, a difficult life.

"I don't know how she dealt with it, but she dealt with it and she still smiled the whole time," family friend Mike Whitcomb said.

If you're confused over a recent email from Facebook regarding its data use policy, you're not alone.? The email ? with the subject line "Up... Read more

A software glitch caused many Facebook users to find themselves members of old groups, ones they may have left a long time ago. More uncomfortably, some people were suddenly members of groups they'd even?been kicked out of. Facebook issued a statement confirming the details.

"A bug surfaced last night that caused some users to be re-added to groups that they previously belonged to," a Facebook spokesperson told NBC News. "We are working to resolve the issue now. In the meantime, we are rolling out a short-term fix for all closed groups that will make the content of those groups inaccessible to the re-added members."

At first, this bug may seem like an annoyance, leading to little more than?a pile of unwanted?notifications?? that's what we saw firsthand. However,?there could be some pretty nasty side-effects. Before Facebook issued that short-term fix, individuals who were added to closed (or "secret") groups were able to view all the non-public content in those groups as well as the current membership rosters. This could leave some sensitive posts vulnerable (though you really shouldn't be posting anything of that nature on Facebook in the first place, whether publicly or privately).

Even public groups (or closed groups which have been turned public since a user left them) can cause issues, as their membership rosters are now visible to everyone.

"I guess you now know that I belonged to a 'Flava of Love' group," Alberto Lima, a blogger for Noisecast,?wrote in a Facebook message alerting me of the glitch. "I swear I never watched the show!" Sure, Alberto. Sure.

Brazil deforestation hits record low

BRASILIA, Brazil (AP) ? Deforestation in Brazil's Amazon rainforest has dropped to its lowest level in 24 years, the government said Tuesday.

Satellite imagery showed that 1,798 square miles (4,656 square kilometers) of the Amazon were deforested between August 2011 and July 2012, Environment Minister Izabella Teixeira said a news conference. That's 27 percent less than the 2,478 square miles (6,418 square kilometers) deforested a year earlier. The margin of error is 10 percentage points.

Brazil's National Institute for Space Research said the deforestation level is the lowest since it started measuring the destruction of the rainforest in 1988.

Sixty-three percent of the rainforest's 2.4 million square miles (6.1 million square kilometers) are in Brazil.

The space institute said that the latest figures show that Brazil is close to its 2020 target of reducing deforestation by 80 percent from 1990 levels. Through July 2012 deforestation dropped by 76.26 percent.

George Pinto a director of Ibama, Brazil's environmental protection agency, told reporters that better enforcement of environmental laws and improved surveillance technology are behind the drop in deforestation levels.

Pinto said that in the 12-month period a total of 2,000 square meters of illegally felled timber were seized by government agents. The impounded lumber is sold in auctions and the money obtained is invested in environmental preservation programs.

Environment Minister Teixeira said that starting next year Brazil will start using satellite monitoring technology to detect illegal logging and slash-and-burn activity and issue fines.

"Over the past several years Brazil has made a huge effort to contain deforestation and the latest figures testify to its success," said Adalberto Verissimo, a senior researcher at Imazon, an environmental watchdog agency. "The deforestation figures are extremely positive, for they point to a consistent downward trend."

"The numbers disprove the argument that deforestation is necessary for the country's economy to grow, he said by telephone from his office in the Amazon city of Belem." Deforestation has been dropping steadily for the past four years while the economy has grown," he said

"But the war is far from over. We still have a lot of battles to fight and win."

For Marcio Astrini, Greenpeace coordinator in the Amazon region, said the lower figures show that reducing deforestation is possible, but he added that "the numbers are still too high for a country that does not have to destroy one single hectare in order to develop."

In a new analysis of thousands of U.S. women of childbearing age, Brown University researchers found that most exceeded the median blood level for two or more of three environmental pollutants that could harm brain development of fetuses and babies: lead, mercury, and polychlorinated biphenyls (PCBs).

In a recent study, more than half of women of childbearing age had median or higher levels of at least two of three pollutants that could harm brain development. Nearly 23 percent of American women of childbearing age met or exceeded the median blood levels for all three environmental chemical pollutants -- lead, mercury, and PCBs -- tracked in an analysis of data on thousands of women by Brown University researchers. All but 17.3 percent of the women aged 16 to 49 were at or above the median blood level for one or more of these chemicals, which are passed to fetuses through the placenta and to babies through breast milk.

The study, published in advance online Nov. 15 in the journal Environmental Research, identified several risk factors associated with a higher likelihood of a median-or-higher "body burden" for two or more of these chemicals.

The three pollutants are of greatest interest because they are pervasive and persistent in the environment and can harm fetal and infant brain development, albeit in different ways, said study lead author Dr. Marcella Thompson. But scientists don't yet know much about whether co-exposure to these three chemicals is more harmful than exposure to each chemical alone. Most researchers study the health effects of exposure to an individual chemical, not two or three together.

"Our research documents the prevalence of women who are exposed to all three of these chemicals," said Thompson, who began the analysis as a doctoral student at the University of Rhode Island College of Nursing and has continued the research as a postdoctoral research associate for Brown University's Superfund Research Program with co-author Kim Boekelheide, professor of pathology and laboratory medicine. "It points out clearly the need to look at health outcomes for multiple environmental chemical co-exposures."

Most of the childbearing-age women -- 55.8 percent -- exceeded the median for two or more of the three pollutants.

Risks of exposure

Data were collected between 1999 and 2004 from 3,173 women aged 16 to 49 who participated in the Centers for Disease Control and Prevention National Health and Nutrition Examination Survey (NHANES). The survey was designed to represent the national population of 134.5 million women of childbearing age. Because the original study also elicited a wide variety of information on health behaviors, socioeconomic and demographic characteristics, Thompson and Boekelheide were able to identify specific risk factors associated with increased odds of having higher blood levels of lead, mercury, and PCBs.

They found several statistically significant risk factors. The most prominent among them was age. As women grew older, their risk of exceeding the median blood level in two or more of these pollutants grew exponentially to the point where women aged 30 to 39 had 12 times greater risk and women aged 40 to 49 had a risk 30 times greater than those women aged 16 to 19.

Thompson said women aged 40 to 49 would be at greatest risk not only because these chemicals accumulate in the body over time, but also because these women were born in the 1950s and 1960s before most environmental protection laws were enacted.

Fish and heavy alcohol consumption also raised the risk of having higher blood levels. Women who ate fish more than once a week during the prior 30 days had 4.5 times the risk of exceeding the median in two or more of these pollutants. Women who drank heavily had a milder but still substantially elevated risk.

Fish, especially top predators like swordfish and albacore tuna, are known to accumulate high levels of mercury and PCBs, Thompson said. However, there is no known reason why they found a statistically higher association between heavy drinking and a higher body burden of pollutants.

One risk factor significantly reduced a woman's risk of having elevated blood levels of the pollutants, but it was not good news: breastfeeding. Women who had breastfed at least one child for at least a month sometime in their lives had about half the risk of exceeding the median blood level for two or more pollutants. In other words, Thompson said, women pass the pollutants that have accumulated in their bodies to their nursing infants.

Although the study did not measure whether women with higher levels of co-exposure or their children suffered ill health effects, Thompson said, the data still suggest that women should learn about their risks of co-exposure to these chemicals well before they become pregnant. A woman who plans to become pregnant in her 30s or 40s, for example, will have a high relative risk of having higher blood levels of lead, PCBs, and mercury.

"We carry a history of our environmental exposures throughout our lives," Thompson said.

Publishers brace for authors to reclaim book rights in 2013 ...

The book publishing industry, already facing disruption from Amazon and ?e-books, will confront a new form of turbulence in 2013. Starting in January, publishers face the loss of their back lists as authors begin using the Copyright Act to reclaim works they assigned years ago.

These so-called ?termination rights,? which let authors break contracts after 35 years, have already made the media thanks to a court squabble between the Village People and music studios.?On the book front, publishers ?and agents are staying mostly mum even though the bestseller lists from 1978 reveal some very big names eligible to reclaim their work ?? Stephen King, Judy Blume, John LeCarre and so on. Here?s a plain english overview of how the law works and why (for now at least) we?re likely to see literary types negotiate rather than litigate.

A Second Bite of the Apple

The law in question is Section 203 of the 1978 Copyright Act which allows authors to cut away any contract after 35 years. Congress put it in place to protect young artists who signed away future best sellers for a pittance.

?People have had 2013 circled on their calendar for a while,? said Andrew Bart, a copyright lawyer at Jenner & Block, in a phone interview.

Termination rights are not a new idea and have been the subject of famous court cases involving John Steinbeck, Lassie and Superman. The difference is that these older cases are based on a pre-1978 law that often required an author to exercise renewal rights which, in many cases, the author had signed away.

The new law has fewer such loopholes and will also mean that what has been a drip-drip of old copyright cases could turn into a flood as nearly every book published after 1978 becomes eligible for termination.

The 1978 law also means a threat to the back list of titles that are a cash cow for many publishers. The threat is amplified as a result of new digital distribution options for authors that were never conceived when the law was passed ? these new options mean authors have more leverage to walk away from their publishers altogether.

Publishers contacted for this story were reluctant to discuss termination rights and several sources said they want to deflect attention from it. That may not be possible for much longer.

?Grist for the Litigation Mill?

Even by the standards of copyright law, the author reclamation rules are a messy cat?s cradle of ambiguous rules and technicalities. The math makes your head spin.

For instance, authors have a five-year window to exercise the right but must also provide advance notice at least two years but no more than 10 years beforehand. For 1978 authors ? who are eligible to reclaim in 2013 ? the window is already closing.

It?s unclear how many understand the rules. Several literary agents contacted for this story appeared to be unaware of how they worked or even of their existence. This is not true of copyright lawyers, some of whom are rubbing their hands at the prospect of a legal trainwreck.

?This will provide grist for the litigation mill,? said Bart, comparing the law to the 1999 safe harbor rules that tied courts in knots for a decade.

For musicians, the reversion rights issue has spilled into court already. Since last year, studios have been claiming that the lead singer of the Village People is ineligible to reclaim copyright. The studios argued the music is an ineligible ??work for hire? and that the whole band ? as joint authors ? must together trigger the termination. The arguments have failed so far as the first judge to hear them sided with the singer in May.

While the ?right to hire? issue may not affect most book authors (who are typically not employees), it may affect some of the country?s most famous writers.

Copyright lawyer Lloyd Jassin?says that some publishers may try to pull a legal ace from their sleeve by pointing to the personal corporations that prominent authors use to license their work. These corporations mean that ? technically at least ? the author may be ineligible since they are employees of the corporation not authors.

Another potential flashpoint for famous authors is what happens to film and merchandise rights if they reclaim copyright. While the law lets studios keep rights to films that are already made, it?s less clear who controls sequels and individual characters.

A Bomb or a Bargaining Chip?

The long awaited (and dreaded) new termination regime kicks in for real in just over a month. For now, though, it?s still too soon to say if the rules will denude backlists in a big way. A?cursory search of the copyright registry suggests that termination notices have yet to flood in (copyrights are public records and a termination and transfer would have to be recorded).

This quiet may mean that many authors are simply unaware of their option to have a second bite at the apple.?Or it may mean that quiet negotiations are taking place behind the scenes. While authors have the option to bolt their publisher, many may prefer to simply seek a sweeter deal rather than fly solo or risk triggering a lawsuit. And, as Law360 notes (sub req?d), there may be only a relative handful of works that are valuable enough to justify expending millions in legal fees.

Details about the rulers are still scarce but, for now, the Authors Guild and Jassin, the copyright lawyer, have very good plain English primers.
