BP trial postponed as settlement talks progress

U.S. Coast Guard via AP

Fire boat response crews spray water on the burning remnants of BP's Deepwater Horizon offshore oil rig on April 21, 2010.

By msnbc.com staff and news services

BP and lawyers for?tens of thousands of businesses and individuals hit by the 2010 gulf oil spill were trying to work out a settlement on Monday after a judge delayed the start of the trial by a week.

Citing three people familiar with the talks, Bloomberg news agency reported Monday that BP and the plaintiffs were discussing a $14 billion settlement.

"I had almost given up on the possibility of a global settlement before a trial began," Edward Sherman, a professor at Tulane University Law School and specialist in complex litigation, said Sunday. "Now, with an extra week, it seems to improve the chances."

A settlement could also be a key step toward BP reaching a?broader settlement with its drilling partners, and with federal and state governments.

During a conference call between BP and a?plaintiffs steering committee?on Sunday,?U.S. District Judge Carl Barbier cited "some progress" in?settlement talks, two people close to the case told The Associated Press.

BP and the committee in a joint news release said they were working to reach an agreement that would "fairly compensate people and businesses affected by the Deepwater Horizon accident and oil spill."

The massive scope of the case ? a maze of claims and counterclaims between the companies, federal and state governments and plaintiffs' attorneys ? has elicited comparisons to the tobacco litigation of the 1990s.

Democratic strategist David Goodfriend argues the Justice Department should take a tough stand against BP even if businesses and individuals reach a settlement.

Mountains of legal briefs
Roughly 340 plaintiffs' lawyers have worked on the case. BP has spent millions of dollars on experts and law firms. More than 300 depositions have been taken. Millions of pages of legal briefs have been filed. One Justice Department lawyer said it would take him 210 years to read all the pages submitted into the record if he read 1,000 pages a day.

Bloomberg's sources said under the proposed settlement BP would close its $20 billion Gulf Coast Claims Facility and shift the facility's remaining $14 billion to the plaintiffs.

The steering committee is overseeing lawsuits filed by individuals and businesses following the explosion on the Deepwater Horizon rig on April 20, 2010, in the Gulf of Mexico. The blast killed 11 workers and injured 17, and led to 206 million gallons of oil spewing from the blown-out well, soiling miles of coastline.

Even with a settlement, much work would remain:

  • The U.S. government has sued BP and others for violating the Clean Water Act and other laws, which could result in fines totaling tens of billions of dollars.
  • Gulf states are also seeking compensation for their losses.
  • BP is also suing and being sued by its drilling partners.

Apart from BP, which owned 65 percent of the Macondo well, the main corporate defendants are Transocean, which owned the Deepwater Horizon rig, and Halliburton, which provided cementing services for the well.?Several other companies are also involved in the trial.

BP has accepted responsibility for the disaster, and estimated its legal and cleanup costs for the spill will total $43 billion. Some analysts have said that figure could top $60 billion, especially if there were a finding that its activities at the project were "grossly negligent."

Earlier this month, BP said it had set aside $6.1 billion to cover claims by businesses. Lawyers for those plaintiffs said the amount was too low, and that BP should also award punitive damages, which the oil company says are not warranted.

Many industry analysts and experts say a quick settlement is in BP's best interest.?

If no settlement is reached, Barbier will preside over a three-phase, non-jury?trial that could last the better part of a year. The first phase is designed to identify the causes of the deadly blowout and to assign percentages of fault to the companies involved in the ill-fated drilling project.

Financial analysts estimate BP could wind up paying anywhere from $15 billion to $30 billion over the lawsuits.

An AP analysis found that the company could conceivably face up to $52 billion in environmental fines and compensation if the judge determines the company was grossly negligent.

The decisions and actions that led to the explosion and spill already have been painstakingly investigated by the Coast Guard, federal regulators and a presidential commission. Their probes concluded that BP, Transocean and Halliburton deserve to share the blame for a string of risky decisions that were designed to save time and money.

Separately, BP has had discussions in recent days with the federal government and cement contractor Halliburton, according to several people close to the case.

Families of crew who died have other needs
Relatives of the 11 killed in the Deepwater Horizon blast say they are hoping for something more elusive: justice for lost loved ones.

Sheryl Revette, whose husband, Dewey, worked for Transocean and was among the 11 killed, doesn't have anything to gain financially from the trial. She wants an apology from the oil giant, something she said she hasn't received yet, even though she settled her claims against BP last year.

"I've never heard a word from them," said Revette, 48, of State Line, Miss. "But an apology isn't going to bring my husband back."

From the beginning of the disaster, many relatives of workers who died on the rig have felt that their tragic losses were unjustly overshadowed by corporate finger-pointing, legal wrangling, and concerns about the spill's environmental and economic impact along the Gulf Coast.

"Nobody cares about the 11 men who died," said Arleen Weise, 58, of Yorktown, Texas, whose 24-year-old son, Adam Weise, was killed in the blast. "Did everybody have to forget about those men?"

A BP spokesman said the company has expressed its sympathies to the victims' families from the outset. In a press release less than a week after the explosion, former BP CEO Tony Hayward said: "We owe a lot to everyone who works on offshore facilities around the world and no words can express the sorrow and pain when such a tragic incident happens."

Chris Jones, whose brother, Gordon, was also killed on the rig, had planned to drive in from Baton Rouge with other relatives to attend the start of the trial. He said he has mixed feelings about the prospect of a settlement that would eliminate the need for a trial. Jones said he would be disappointed if BP manages to "write a check to solve their problems."

"I was ready to go to trial and see their feet held close to the fire," he said Sunday after learning of the postponement. "It seems like the easy way out to pay whatever the plaintiffs are willing to take."

Jones, an attorney, said he's not surprised that the oil giant would seek to avoid a long, costly trial.

"I know that is part of the game, so to speak," he said. "As long as they're paying a lot of money for the damage they caused, it would give me some relief."

The Associated Press and Reuters contributed to this report.

Dirty-Energy Money

istock

istock

Big Coal and Big Oil know that, in their business, political friends are worth their weight in gold. An academic study of one case of corporate lobbying estimated the return on investment at 22,000 percent: a dollar spent earned $220. Jack Abramoff, the convicted, influence-peddling super-lobbyist, pegged the return on investment of one project at 100,000 percent: $4 million dollars in lobbying cash purchased a $4 billion tax break for Tyco International.

Inspired by paybacks like those, the dirty-energy industry lavishes money on campaigns and lobbying. Not surprisingly, among its favorite sons are Rep. Joe Barton (R-Texas), who famously apologized to BP for Congress?s criticism during the Gulf oil disaster, and Sen. James Inhofe (R-Oklahoma), who insists the science of global warming is a hoax and has likened the US Environmental Protection Agency to the Gestapo. Rep. Barton has raked in $1,914,183 and Sen. Inhofe $1,287,950 from Big Coal and Oil?amounts that bring to mind social critic Upton Sinclair?s observation: ?It is difficult to get a man to understand something when his salary depends upon his not understanding it.?

But what about Cascadia, with our hydropower and wind turbines, energy efficiency and smart growth? Does the lucre of Big Coal and Oil taint our delegation to Congress too? We pulled the numbers from the Dirty Energy Money Campaign, which compares recent Congressional votes on a dozen indicative energy policy issues with campaign contributions from fossil energy companies. The answer is unpleasant: even in the Northwest, Big Coal and Oil are dumping train loads of cash on our democracy?almost $5 million since 1999?and the main recipients are hewing to the dirty-energy line. These figures actually understate dirty-energy political money dramatically. They reflect campaign contributions made by energy companies and their key? employees. They ignore contributions made by major investors in these companies and the huge sums of political money that filter to candidates or their election through the bank accounts of lobbyists, PACs, and Super-PACs. Think of these figures as the tip of the iceberg: the visible part but not the most dangerous part.

In the figure below, Cascadia?s representatives in the US House of Representatives and Senate appear by state and party. Their contributions since 1999 from coal and oil companies show up as the length of their bar, and the percentage listed with each bar displays the share of the time that they have sided with the fossil-fuel interests in twelve key votes. Seven of the top eight recipients of dirty-energy political dollars voted with Big Coal and Oil 100 percent of the time. Of the twelve who received the least dirty-energy money, nine never voted with Big Coal and Oil, two voted with them just once, and only one voted the Big Coal and Oil line.

In the Northwest, Alaska and Montana are the main oil and coal producers, and their delegates get the vast majority of political money from Big Coal and Oil. As the figure below shows, the average Alaskan member of Congress has received more than five times as much as the average Oregon member. Until recently, Washington and Oregon have not been major players in the fossil-energy industry; however, with the coal-export debate raging, more coal cash may infiltrate the states.

Contributions may also swing from oil to coal interests. In the past, oil?with its higher profits?has been the bigger gusher of political money, as the figure below illustrates.

Dirty-energy political money flows from a long list of companies. ExxonMobil leads the contributors to members of the current Congress, followed by Koch Industries and Chevron. Among the top ten (shown above) are also well known petroleum companies such as ConocoPhillips and BP. Less-familiar names include Fluor, which does engineering, construction, maintenance, and the like for big energy companies; it also does work at the Hanford Nuclear Reservation in Central Washington. The Southern Company owns power utilities that burn a lot of coal in Georgia and other southern states. Williams is a giant, Oklahoma-based natural gas company.

These ten companies accounted for about 30 percent of all dirty-energy political contributions made since 1999 to incumbent members of Congress from the Pacific Northwest. Each state has its own particular mix; for example, the top contributor in Montana is PPL, which does not support any politicians in Washington State. PPL, among other things, is part owner of the enormous Colstrip coal-fired power complex that sells electricity into Cascadia from eastern Montana.

Members of the Republicans Party get three times more dirty-energy money than do Democrats. The average Republican hauled in over $300,000 in donations from Big Coal and Oil, with Alaska Senator Lisa Murkowski receiving the most at nearly $1 Million, more than all contributions to Washington State?s Senators and Representatives combined. In contrast, Democrats averaged less than $100,000 each, a number that drops to $54,000 if we exclude Montana?s senior senator Max Baucus, who has received $661,000 since 1999.

If we were to take the standard view on this issue, we would expect a direct correlation between the amount of political money a politician received from Big Oil and Coal, and the way she or he voted on subsequent legislation. But as Lawrence Lessig establishes in his new book Republic, Lost, that?s not how money corrupts our democracy. The process is more subtle and ruinous: politicians, who spend more time fundraising than doing any other single waking activity, develop a sixth sense for their funders? interests. Their positions on issues often lean toward money long before they even solicit contributions from a source. As former lobbyist Jimmy Williams observes, incumbents often reach out to lobbyists in order to finance their re-elections. Many use their voting record to demonstrate their commitment to the cause.

Not surprisingly, given the intense political polarization sweeping the United States, voting records correlated even more closely with party than dollars received. Ten of eleven Republicans voted with dirty energy 100 percent of the time, and the eleventh did so 58 percent of the time. Of the sixteen Democrats, thirteen voted against dirty energy every time, two did more than 90 percent of the time, and the last did 75 percent of the time.

The dirty-energy political money we?ve documented here is the tip of the iceberg. Our figures ignore the millions that companies and their owners give to lobbyists, PACs, and Super-PACs. It ignores contributions to state and local races and on ballot measures (such as this cynical and anti-democratic one). But even without a full view of the ledger, the conclusion is troubling: Big Coal and Big Oil have spent almost $5 million on campaign contributions to the current US Congressional Delegation from Cascadia, a region that prides itself as an emerging leader in the clean-energy economy.

Sources and Notes: Data from the Center for Responsive Politics with additional analysis by Oil Change International. Throughout the article and in all figures, the contributions reported are total receipts since 1999 of the Northwest?s current Congressional delegation, including both US Senators and Representatives. No data were available for Rep. Susan Bonamici (D-Oregon), who only recently took the seat vacated by David Wu when he resigned in August 2011. One of the main contributors to politicians of both parties in all states was the National Rural Electric Cooperative Association. In much of the United States, rural electric coops support fossil energy. In Cascadia, however, they use primarily hydropower and have a mixed lobbying stance on fossil fuels. We therefore removed NRECA from the data set.

Home Improvement Tips to Make Your Home More Beautiful and ...

There isn?t a home that wouldn?t stand to gain something from some well-laid out home improvement projects. Making a few significant positive changes to your home doesn?t necessarily mean that you need to be highly dexterous or to have a huge bank account. We?ll be offering some advice in this article which should show you that all you need to do is to make some creative changes in key areas.

Most homes have either a basement or attic, or perhaps both, and these spaces are seldom used to their full potential. A basement or an attic could be converted into a living area like a studio or office. There are many possible uses for this, including a work area for you, a bedroom for a child or even a rental unit that could bring in extra income. You already have the essential components of a room, which are the walls, ceiling and floor. However, it?s likely that this area will need work and remodeling to make it into a livable space. You could add a kitchenette, need to clean out mold or air out a damp basement, or add some plumbing. These jobs will be worth the work in the end because of the benefits you will derive from them. Well, we hope you are duly impressed with just this little bit about justin bieber news. To make things even better, you just need to push the envelope a little bit by discovering more beyond this article.

Yes, you will not only understand this better, but the knowledge you gain will have a positive impact. There are tremendous benefits to be had once you reach that particular place. It is natural for us humans to want to have some degree of command over the events and situations in our lives. You can make a big difference in the appearance of your home by replacing all or some of the windows in your home which can also help with energy efficiency. Getting energy efficient windows is one of the best ways to insulate your home and save on heating bills. You could also think about window coatings that will maintain a lower temperature during summer and a higher one during winter, like low-e. Quality windows add value to a property, in different ways, and they are worth the investment. Not only do they provide insulation, but they can be decorative as well, so make sure you choose the right style of windows that compliment the rest of your house.

Outdoor living areas can be improved greatly by the addition of a pool, sauna or spa. The addition of a spa or swimming pool used to be a considerable investment; nowadays these items are well within our range, due to modern manufacturing techniques. The designs of spas and pools are limitless; there is one out there that will fit your needs. You can gain the health benefits with a spa, along with having the availability of a heated, relaxing treatment in the middle of the winter.

There are many types of pools, hot tubs and spas, including portable ones if you don?t want to go to the expense of having one installed.

You can give your home a new look, improve its comfort, energy efficiency and monetary value with the aforementioned home improvement ideas. The only way to succeed with any home improvement project is to actually get started. Make this the year you start converting your home into what you dream of, so put a plan together, get the right stuff or call the right builder.

The feedback about this is typically along the lines of surprise reactions when people read about justin bieber pictures, here. You have to bear in mind that this topic is related to several others that each in their own right are significant.

Do pay close attention as you begin to move from one topical area to another. Going beyond what has been talked about here, you may want to pick something that appeals to you or is relevant. What needs to be done, then, is well known and you will run with it.

In the end, though, this is clearly your option to pursue or not.

Taylor Swift Invites New Jersey Teen To ACM Awards

Country superstar declines Kevin McGuire's prom invitation on Facebook — but she has a better idea.

Taylor Swift has asked a fan to be her date to an awards show, and it all started on Facebook.

Less than 24 hours after the sister of a leukemia-stricken New Jersey teen made a plea to the country star in an online video, Swift responded via her official Facebook page.

"Kevin, I'm so sorry but I won't be able to make it to your prom," she wrote. "But I was wondering, the ACM Awards are coming up... Would you be my date?"

Swift's camp confirmed to MTV News that the Facebook post is legit.

Kevin McGuire, an 18-year-old high school football star, has his sister to thank for the invitation. Looking for ways to support her brother as he underwent treatment for a relapse of the disease he was diagnosed with five years ago, Tori McGuire set up the "Taylor Swift Take Kevin McGuire to Prom!" Facebook page, which had nearly 100,000 followers at press time. The Twitter hashtag #TeamKevin had gotten the attention of a number of celebrities, including Perez Hilton, Travie McCoy, Michael Vick and Troy Aikman.

"All throughout Kevin's treatment he kept his character intact, remained playing basketball, and even started varsity football as a freshman," she wrote on the Facebook page. "Kevin is known throughout the community as the High school's 'real life SUPER MAN!' Tragically, Kevin had a relapse, and is now fighting cancer for the second time. Kevin is the kindest, most noble 18 year old a person could even fathom meeting, and throughout his ups and downs Kevin never even questioned 'why me?' Nothing, and I mean NOTHING brightens Kevin's day more than Taylor Swift. Kevin DESERVES more than anyone a special event in his life."

Comments quickly flooded Swift's post and new remarks appeared on McGuire's Facebook page as well.

"Congrats! The ACMs are way better than the prom!" wrote Connie Spross, a supporter.

The 47th annual Academy of Country Music Awards are scheduled to take place Sunday, April 1, in Nashville. Swift is nominated for several awards, including Entertainer of the Year, Female Vocalist of the Year and Video of the Year.

What do you think of Taylor's response to Kevin? Let us know in the comments!

Book Review : BOOK REVIEW: Consciousness: Confessions of a Romantic Reductionist by Christof Koch

There?s a famous quip circulated among writers: The craft is easy. You just sit down at your desk and open a vein. In his latest book, Koch does one better. He pries off his skull, splits open his brain and invites the reader in.

What?s inside is fascinating. Through scenes from his life as a wandering child, an ambitious young researcher and an erudite professor, Koch describes his compulsion to discover the roots of consciousness.

The book is a testament to the power of the subjective. Koch lays bare his most profound losses, confronts his mortality and describes his wildest ideas all in the confessional style of St. Augustine.

One of his chief confessions: At heart, Koch is a romantic who sees a world brimming with meaning. This deeply philosophical view anchors the book, which includes quotes from Haruki Murakami, Oscar Wilde and Dante.

Also near Koch?s heart, though, is the seemingly contrary scientific desire to untangle the incredibly complex questions of consciousness ? what it is, who has it and why. In his wide-ranging discussion of the latest brain science, Koch points out examples of experiments that provide some clues. His crisp descriptions of science capture the essence without a trace of puffed-up jargon.

Along the way, Koch discusses free will (which he calls a ?scholarly minefield? before charging straight in); animal consciousness (he no longer eats mammals or birds); and how religion fits into his view of the universe (he has gradually lost his Catholic faith).

Koch weaves a vivid and poignant story, punctuated by fascinating characters and compelling science. The book will leave you with a small piece of Koch?s own consciousness, plucked from his head and delivered into yours.

Culinary Union suggests Bill of Rights for MMA fighters

The Culinary Union, the biggest union representing workers in Nevada, stopped by the Nevada Athletic Commission's meeting on Wednesday to discuss ways to improve treatment for fighters. They want to see the NAC lead the combat sports world by pushing for reforms in MMA.

It wants to see:

1. Equal protections for all fighters. Boxers are protected under the Muhammad Ali Act, which enacts certain rules over boxers that keeps them from getting exploited. Mixed martial artists are not.

2. Right to work. This would allow fighters to sign non-exclusive contracts and would prohibit contracts from automatically renewing. Champions' clauses, which keep champs attached to their contract as long as they hold the belt, would be a thing of the past.

3. Inalienable right to your own name, likeness and image. When Jon Fitch objected to handing over his image in perpetuity to the UFC for its video game, he was cut from the UFC and Dana White threatened to not do business with any fighters from Fitch's gym, American Kickboxing Academy. After Fitch played ball, he was brought back into the fold. This right would allow fighters to exercise the right Fitch wanted to.

4. Free market of sponsorships. This would not just allow fighters to get whoever they would like to sponsor them, but would also let them say no to their promotion's sponsor. In other words, Brock Lesnar could chug a Coors and Carlos Condit could have walked away from a Harley-Davidson if he wanted to pursue a sponsorship with Honda.

5. Transparency of contracts and payments. Fighters would get detailed financial statements from any event they participated in. This would be particularly important to fighters whose contracts earn percentages of pay-per-views or gates.

6. Fair share of revenues. In the NBA and NFL, athletes went through a lockout to fight for roughly half the league's revenues. Because Zuffa is a private company, their revenues are not public, so we have no idea how much revenue the fighters earn. This right would ensure fighters get at least a quarter of revenues.

7. Freedom of association. Fighters would be allowed to unionize in any way they see fit.

8. Right to healthcare insurance for training and fighting. Zuffa fighters are given medical coverage for both fight camps and fights, but this right would ensure it continued.

9. Right to fair fights. The UFC's matchmaking system generally provides fair and evenly matched bouts, but things get murky on subjects like who deserves a title fight. Timing often decides title matches as much as an independent ranking system. This right would call for a transparent ranking of fighters.

10. Professionalism. From the union: "You have the right to be treated with common courtesy and professional respect by other fighters and by promoters and managers. For mixed martial arts to become a mainstream sport accepted by the general public, participants in the sport must act in accordance with commonly accepted standards of courtesy, decency and respect in their public interactions with one another and in their interactions with the public."

In other words, promotions couldn't fire one fighter because of a tweet about rape while not firing another for jokes about child molestation. UFC executives would probably have to stop dropping F-bombs at Twitter followers.

Would you be in support of such a bill? Is it missing anything? Tell us in the comments, on Facebook or on Twitter.

Stocks' rally may come to an end this week

If upcoming earnings from U.S. retailers are as unimpressive as the rest of the profit season has been, Wall Street could face a tough time justifying a stock market at nine-month highs.

Even with a Greece deal now in the works and the U.S. economic recovery showing stronger momentum, strategists think the market could face resistance in a push higher.

Less than two months into the year, the benchmark Standard & Poor's index is up more than 8 percent and has already exceeded many analysts' forecasts for the year.

The problem is the market has not seen as much upbeat news out of this earnings season as it has in recent ones.

"Earnings have generally come in more disappointing than they have been," said Robert Van Batenburg, head of equity research at Louis Capital in New York. "I don't think there's a lot of fireworks coming" from last week's financial results.

The index ended Friday at 1,361, its highest since May 2011. That was above a Reuters poll forecast in December that the index would end 2012 at 1,340.

A break above 1,370 would put the S&P 500 at its highest since June 2008, before the September 2008 collapse of Lehman Brothers.

The Dow industrial average is fast approaching the key psychological level of 13,000, while the Nasdaq has been trading at its highest since 2000 and is near the 3,000 level.

S&P 500 earnings performance has so far trailed recent quarters in terms of beating Wall Street's estimates. The percentage of companies beating analyst profit expectations is at 64 percent, according to Thomson Reuters data.

While that percentage has improved since the start of the earnings season, it's below the average beat rate for the past four quarters of 70 percent, the Thomson Reuters data showed.

This week brings results from top retailers, including Wal-Mart and Home Depot. Companies in the consumer discretionaries group so far have a beat rate of 70 percent, above the average for the S&P, but many retailers in the group have yet to report.

The week is seen as one of the last big ones of the earnings period.

With results in already from 404 S&P 500 companies, investor focus already may have shifted away from earnings.

That leaves a lot of focus on the outlook for Europe and the U.S. economy. Data on existing- and new-home sales is expected this week.

News of a deal for Greece, expected to help the country avoid a messy default, has helped drive stocks higher as has stronger data on the U.S. economy.

Euro zone finance ministers are set to meet on Monday about the financial rescue for Greece. U.S. markets will be closed for the Presidents Day holiday.

The market's recent run higher has put it at some key technical levels that some say could cause it to stumble.

"The market is likely to reach a short-term top," said Bruce Zaro, chief technical strategist at Delta Global Asset Management in Boston.

The percentage of New York Stock Exchange stocks trading above their 50-day moving averages is in the 85 percent to 90 percent range, he said, which is typically a signal that the market is overbought.

He sees a pullback to the 1,260 to 1,270 range on the S&P 500 in the near term.

Some strategists said they would see a break above 1,370 as a key buying opportunity.

"You break out to 13,70 to 1,380 and then you have to say to yourself something real is happening here. I'm kind of on the sidelines until I see that, but I will be jumping in if that starts happening," said Stephen Massocca, managing director at Wedbush Morgan in San Francisco.

The CBOE Volatility index, Wall Street's fear gauge, was down 7.5 percent on Friday and has been below the 25 level for more than two months, suggesting investors are less worried about the market's outlook.

Pujols joins Angels in camp

By TOM WITHERS

updated 9:51 a.m. ET Feb. 20, 2012

TEMPE, Ariz. - Albert Pujols has arrived to begin his first spring training with the Los Angeles Angels.

Just as the sun was illuminating the Angels' facility, Pujols pulled his black Mercedes into the players' lot. Clutching a bag with some of his belongings, the three-time NL MVP headed to the clubhouse to meet his new teammates. The slugger's first stop was the equipment room, where he was introduced to several employees and clubhouse attendants.

Pujols left the St. Louis Cardinals after 11 seasons in December for a roughly $250 million contract with the Angels. He is scheduled to take infield and batting practice before holding a news conference at a hotel to discuss the next phase of his illustrious career.

Will Our Senior Loved Ones Accept Home ... - Senior Care Corner

Home automation is going to give our senior loved ones the ability to live in their homes more safely, enjoyably and comfortably, many well into their elder years.

Home monitoring using video and motion detectors is going to give family members and other caregivers peace of mind, knowing the seniors about whom we care are safe and well ? and that they?ll get notification quickly if not.

The exhibition floor at the 2012 International Consumer Electronics Show (CES) included many devices and systems that carry the promise of letting seniors live independently at home, often without the need for regular caregiver support, for longer than previously thought practical.

Not only is living out our lives in the home of our choice, known as aging in place, a desire of many adults but it is also typically a far less expensive way to live than in senior living facilities. With savings and retirement plans strained and the future fate of Social Security uncertain, being less expensive is an added attraction of aging in place.

So, all is great, right ? or is it?

Despite doubts expressed by some family members and some ?experts?, we expect most seniors will eventually not only accept but also embrace home technology that makes life more comfortable and enjoyable. After all, the next set of surveys is likely to show that a majority of seniors are online, using computers, smartphones and tablets to surf the web, use social media and much more. Also, the senior population includes a growing number of boomers. While they didn?t grow up with technology in the same way as younger generations, the technology grew up with the boomers.

When it comes to in-home monitoring technology, will our senior loved ones embrace, accept or even tolerate it? Will we when our time comes?

Home technology can and will be able to give family caregivers peace of mind by letting them know that

  • mom is getting out of bed each day,
  • grandpa is going into the kitchen to eat, or
  • the senior loved one developing Alzheimer?s is not wandering out of the house alone.

That same technology, though, may also be seen by senior loved ones as intruding on their privacy and taking away their independence in a way that even a live-in caregiver might not. Sleeping late because you socialized late the night before or not wanting lunch because you had a big breakfast are not indications of problems, but may draw questions from your family because the monitoring system was triggered.

Both would be seeing the same thing, of course, but from different perspectives. Who?s right? If the objective is to improve the lives of senior loved ones, we hope THEY feel their lives have been improved. That means we have to put ourselves in their shoes and seek technology solutions that can be embraced.

What?s the solution? Certainly there will be cases where the well being of a senior loved one outweighs what they want, but maybe that step can be avoided with efforts up front. After all, remote controls, computers, cell phones and other devices were all new to them at some point and have been embraced by most.

We care enough to want to do it right.

Coming next, potential steps to get senior loved ones to embrace monitoring technology. Check back here or sign up for our updates so you don?t miss it.

Samsung spinning off its LCD business to focus on OLED | The Verge

We knew that Samsung was thinking about spinning off its unprofitable LCD business, and while its disclosure on February 14th stated the company would make a final decision within three months, a new filing shows Samsung is going ahead with its plan. Bloomberg reports the new subsidiary is tentatively named Samsung Display Co., and could be merged into Samsung Mobile Display Co., allowing the company to shift resources from LCD to OLED production. Samsung Mobile Display was set up as a partnership between Samsung and Samsung SDI in 2009, and is the company behind Samsung's OLED displays for smartphones and other mobile devices.

The move follows the 750 billion won operating loss (about $668 million) realized by Samsung's LCD business in 2011. Everyone's having a hard time making money selling LCD TVs, but having seen the 55-inch OLED set in person, we would expect that red ink to start drying up if Samsung Display is able to get big screen OLEDs in the market at a reasonable price point.

How To Protect Your Eyes And Avoid Eyestrain | New Health and ...

New Health And Fitness.Org - Health Information You Can Use

People of all ages are suffering from eye strains because of the predominance of television, computers, and videos in today?s world. Living in the city full of smog and driving a car are also considered as main reasons for eye strains. When it comes to eyestrain, the common symptom is the blurry appearance of the letters on the computer screen or in the print of the page, which normally appear clear. The eyes hurt so bad that you are forced to shut them for some time.

The most common remedies to cure this problem are

Take breaks from work. You need to take a break of about two minutes after every hour if you are working on a computer or doing any other type of work which involves working your eyes at a close distance. If you simply close the eyes and do nothing, then this will give the eyes the much needed rest.

To refocus, stop reading. It is highly advisable to take a short break after every 30 minutes and look far away into the distance if you are reading continuously. There is a muscle in the eye that contracts when you are working with your eyes close-up. When you shift the focus to an object at a distance, you relieve the muscle of its strain.

How about having a tea break? For the strained eyes, using an eyebright tea is a gentle balm. A mixture of various herbal material sold by the health food shops as a remedy for the eyestrain is eyebright tea. In the eyebright tea, soak a towel. Over your closed eyes, place this warm towel as you lie down. You can leave it on for 10 to 15 minutes. Be careful so that you can ensure that the tea does not drip down into the eyes and should be warm but not scalding hot.

Try blinking your eyes. Nature has given human eyes their personal masseur viz. the eyelids. Consciously blinking the eyes instead of squinting will cleanse and give them the required massage.

Use glasses. If you have problems seeing but avoid using glasses due to vanity, you are bound to suffer from eyestrain. If your distance vision is good but cannot read up close then it is highly advisable for you to get a good pair of reading glasses to avoid eyestrain. It is highly recommended to use glasses for curing eyestrain in ever your distance vision is bad.

Eye muscles should be exercised. Try standing at a distance of about five feet from the blank wall. While you stand there, ask someone to toss a ball and you can catch it every time it bounces off. Alternatively, hold your thumb at the arm?s length, move it in circles and Xs, bringing it closer or far away and follow it with your eyes. These exercises offset the damage caused by eyestrain and improve the brain to nerve coordination for enhanced vision.

These life coach tips will help you get what you want in life.

Among the tidbits: Jim Carter, who plays dignified butler Carson, takes part in charity bike rides worldwide, and Elizabeth McGovern, who is the show's Lady Cora, is in a band called Sadie & the Hotheads.

The PBS graphic doesn't address the fate of star-crossed lovers Lady Mary and Matthew (Michelle Dockery, Dan Stevens).

"Downton Abbey" is about an English estate's family and servants in the early 20th century. It has proved a hit for PBS.

The second-season finale airs 9 p.m. EST Sunday on public TV stations.

Get Creative or Get Out ? A Girl Named Jillian

I?ve been meaning to write this post for a really long time? but it took Valentine?s Day to bring it back top of mind.

Every so often I write a ranting blog post about ?crazy women.? You know those women? whiny, dramatic, jealous, obsessive and {worst of all} needy. They give me the shivers. The women who check his phone to see who he?s been texting. The women who go on three dates and then assume they?re in a long-term relationship. The women who talk roses and babies before hobbies and allergies. The women who ditch their friend circle so that they can spend time with him. The women who pretend to be someone they?re not, just to please him. The women who say things like ? you?re the best sugar, you?ll always be my baby. [Puke.] The women who get cheated on and throw all the things that remind her of him off the balcony. Ok fine, that last one was me. ;) Moving on?

Well today is about crazy men. The kind of men who propose on Christmas Day, Valentine?s Day or any other day of the year that already has a meaning attached to it.

I consider myself to be well-rounded, fairly open-minded and I?m only ?crazy woman? a few times a year. {No incidents in 2012 yet!} I have dated my share of bad news bears, good guy/bad timing and what-was-I-thinking. I have a diverse group of friends and family. Some of my friends are married or engaged, others single. My best friend is a guy. I know there are people reading this who are thinking? how can she write about this when it hasn?t happened to her?

Well let me tell you this? every time I see a holiday engagement announced on Facebook, a little bit of my heart dies. Yep it shrivels up inside and takes about 15 mins to come back to beating and love-filled. When it does? it screams from my chest:

What the hell was he thinking?

For real.

A {strength and} weakness of mine is transparency. I tend to tell people what I think? and sometimes it ends in a heated debate. For example: last year I blogged on why I think Valentine?s Day is stupid and I had a load of ?crazy women? {?let?s assume} send me hate mail. So anyways if a dude every proposes to me on any freakin? holiday, any almost a holiday, my birthday, his birthday, my mom?s birthday {4/20, Columbine, Hitler?s Birthday}, his mom?s birthday, February 29, some cutesy date (ie. 12/12/12 etc}? I?m calling it quits.

That?s right. Quits.

Holiday proposals are the worst. It?s almost like? ?Oh hey? I was thinking of proposing to my girlfriend. I bought a ring. I?m pumped man. Well when should I do it? Christmas is coming. That?ll be perfect.?

Um. No.

To start with, it?s absolutely the most unoriginal engagement ever. I don?t care if you dress up in a frickin? Santa suit and get a team of reindeer? a holiday engagement is not going to gain you any points. In my opinion, piggy backing on a holiday shows convenience {insert boo?s from every guy who has ever proposed during this time ha ha?} and who wants to marry the dude who took the easy route?

On another note, why do people think its important to propose in front of your family or friends? I get it if it?s religion or culture related? but I?m positive it sets a hell of a lot of expectation for the girl to say ? YES, oh baby YES. Pressure and expectation created by your significant other should not come into play during engagements. You both should be deliriously happy. Your engagement is about the two of you. No one else. If there are questions, concerns or uneasiness? they should be addressed, not ignored {which is what will happen if people are present.} Can you imagine what would happen to the ending of The Bachelor if they had the chick?s family waiting at the end of every season finale? A hell of a lot more YES I can?t wait to spend the rest of my life with you ?{and an increase in quick divorces}.

{Family Proposal Exception: The scene in Love Actually where the guy proposes to the girl in the restaurant in front of her family in her mother tongue? he got points for sure.}

I can?t speak for every girl in this world (and definitely not the crazies)? but there is a lot to be said about being both creative and compassionate. I believe a lot of guys propose on holidays because they don?t know when they should propose. I think that if you don?t know? then don?t do it. Also if you?re web-savvvvy ;) and Google ?when should I propose? the Internet will also tell you? don?t propose on a holiday.

If you know her well enough to want to spend the rest of your life with her then I definitely think you?ll know what?ll make her heart swoon and jump with love-filled joy. Don?t focus on making it elaborate or expensive ? just make it special and a memory that the two of you can hold onto for years to come.

Make a date yours.?

I have never planned out or thought about my engagement, wedding or future ? and my girlfriends and I don?t sit around talking about the topic. We?re all like-minded and go with the flow in regards to relationships. We know that one day the right one will walk along and he?ll think holiday engagements are just as stupid as we do.

If a guy were to propose to me tomorrow? all I would hope is that he would think outside the box. Or at the very least? propose over pancakes. As he would know they are my absolute favourite thing in the world. ;)

PS ? When I am somewhere near engagement territory {probably in 2045}? please send the dude this post. Let?s hope the Internet still exists then.

Importance of Strategic Planning and Management in the Business Paper
Artim Toska

March 29, 2010

Introduction
This paper will describe a small business I may want to start, define strategic management and planning, and explain why a strategic plan would be important to the success of this business. ? Also, it will explain the four functions of management relative to creating and implementing a strategic plan.
Strategic management & Planning
In a competitive business world, it is important to have your business prosper for it to overcome the challenges it may encounter. ? The direction (and future) of a small business has extreme challenges in an economy that lags, but can be overcome with the right strategic mananagent ideas and planning.
A small business that I would like to start would be a financial business that would provide short-term capital to small working and expanding companies. ? I believe this business would provide profits in an economy that has been ailing small businesses. ? Small businesses would welcome my services since they can not (or find it difficult) to finance their business when banks are not giving them the capital they need to remodel or have their business survive.
Strategic management is planning your business at the highest possible level. ? This would be the duty of the company?s leader (or leaders) to focus on building a solid structure to that business (All business, 2010). ? This ?structure? will be ?hinged? on the effort of each employee that is hired. ? Also, strategic management helps answer what are the objectives of the business, the best procedure in achieving these objectives, and what are the resources that are needed to make that happen (All business, 2010).
Strategic planning determines the direction that an organization will be headed over the next year or more, and how it will arrive there (McNamara, 2010). ? Usually, the process is throughout the organization and focuses on a major function as?

More US government websites hacked by Anonymous

(AP) ? The hacking group known as Anonymous has claimed a new series of hacks against the U.S. Federal Trade Commission and consumer rights websites.

The loosely organized collection of cyber rebels said it attacked the FTC's consumer protection business center and the National Consumer Protection Week websites.

Both sites were replaced with a violent German-language video satirizing the Anti-Counterfeiting Trade Agreement, or ACTA.

ACTA was recently signed by several countries, but restrictions on online piracy have prompted a growing protest movement.

A call to the Trade Commission rang unanswered before business hours Friday. An email seeking comment was not immediately returned.

The organization's main home page appeared unaffected by the attacks.
